Merchandise Collection Terms of Service
Terms of Service and Account Activity
Athlete Brands can only provide our merchandising service for athletes with an active account. Services include custom graphic design, mockup creation, direct payouts, the fulfillment of orders, shipping and delivery organization, web hosting, landing page creation, and online collection availability. These services are free for 30 days, then only $4/month to maintain these services after your collection is launched.

Earnings Per Sale
Each athlete will receive earnings from each merchandise sale based on the specific item sold. Athlete earnings per sale are as follows:
Tees: For each graphic tee sold, athletes will earn $11.25, approximately 82% of total profit.
Crewnecks: For each graphic crewneck sold, athletes will earn $12.50, approximately 83% of total profit.
Hoodies: For each graphic hoodie sold, athletes will earn $12.50, approximately 83% of total profit.
Custom Necklace: For each custom necklace sold, athletes will earn $15, approximately 50% of total profit.
1. Terms of Service and Creation of Merchandise
Athlete Brands reserves the rights to withhold service to athletes based on:
- The athlete provides images outside of the standard quality. (Low-quality photos)
- The athlete fails to provide 5-10 high-quality images.
The Athlete Brands support team will contact athletes who fall into these categories. After we have contacted the athlete, the management of their subscription is under their control and is up to the athlete to cancel their account.
2. Distribution and Payment of Earnings
Earnings from each sale will be calculated at the time of purchase and distributed to the athlete on a monthly basis. Payments will be made directly to the athlete's designated payout method, most commonly PayPal.
3. Potential for Temporary Funds Withholding
Athlete Brands reserves the right to hold a percentage of funds from each sale to address potential refunds, chargebacks, shipping, delivery, or other logistical concerns that may arise to ensure smooth processing of orders. Additionally, Athlete Brands may hold a portion of funds if necessary to upgrade merchandise quality, including but not limited to changing materials or print providers to mitigate logistical or quality issues.
Athlete Brands is committed to providing athletes with an 80-100% share of the profit from each merchandise sale, depending on various factors including product type, potential funds withholding, and other operational considerations. Here’s a breakdown of how these factors impact final earnings:

Product-Specific Profit Margins
- Each product has a unique cost structure, which impacts the profit available per sale. For example, graphic tees and hoodies have different production and shipping costs, leading to variations in the remaining profit margin. Athlete Brands aims to provide athletes with a high percentage of this profit, ranging between 80% and 100%.

Funds Withholding for Logistical Costs
- Athlete Brands may withhold a small portion of funds temporarily to cover possible refunds, chargebacks, or delivery issues. This precaution ensures that unexpected expenses don’t impact the overall financial health of the program. When funds are withheld, athletes may receive closer to 80% of the profit to account for these potential costs.

Upgrades and Quality Adjustments
- Occasionally, Athlete Brands may retain a portion of funds to upgrade merchandise quality. For example, if a higher-quality material or print provider is needed to maintain standards, funds may be allocated for this improvement. Such adjustments ensure that items meet consumer expectations, preserving the brand’s reputation and supporting long-term sales.

- Additional factors, such as regional shipping costs or promotional discounts, might impact profit distribution. Athlete Brands actively works to minimize these variables but may adjust the final earnings percentage as necessary to balance these costs effectively.
Athletes generally receive 80-100% of the remaining profit after basic operational and quality assurance costs are accounted for. This flexible model allows Athlete Brands to deliver reliable payouts to athletes while maintaining service quality and ensuring successful order fulfillment.
By completing the checkout process and signing up for the "NIL Merch Collection" program or the "NIL Sponsorship Program", each athlete understands and consents to these terms, including the associated earnings distribution model and the possibility of funds being allocated for operational or quality control purposes. This agreement helps ensure a reliable and sustainable experience for all athletes participating in the Athlete Brands merchandise platform.
